Geltungsbereich<\/h4><p>Die nachstehenden Allgemeinen Gesch\u00e4ftsbedingungen (AGB) sind Grundlage des Maklervertrages geworden. Der Kunde hat die Einbeziehung dieser AGB in den Maklervertrag anerkannt und best\u00e4tigt, dass ihm ein Exemplar dieser AGB \u00fcbergeben wurde oder er auf die M\u00f6glichkeit hingewiesen wurde, diese AGB hier \u00fcber das Internet unter www.blex-immobilien.de einzusehen.<\/p><p><strong>\u00a0<\/strong><span style=\"letter-spacing: 0px;\">Soweit einzelvertragliche Regelungen bestehen, welche von den Bestimmungen dieser abweichen oder ihnen widersprechen, gehen die einzelvertraglichen Regelungen vor.<\/span><\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-a9cc29e elementor-widget elementor-widget-text-editor\" data-id=\"a9cc29e\" data-element_type=\"widget\" id=\"terms2\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<h4>2. Maklerprovision<\/h4><p>Der Kunde der Firma Andreas Blex Immobilien verpflichtet sich, bei Abschluss eines durch die Firma Andreas Blex Immobilien vermittelten Vertrages (z. B. Kaufvertrag, Mietvertrag, Pachtvertrag, Nutzungsvertrag, Beteiligungsvertrag usw.) eine im Maklervertrag oder in innerhalb einer anderen Vereinbarung n\u00e4her bezeichnete Maklerprovision zu zahlen.<\/p><p>Sollte eine solche Provision nicht ausdr\u00fccklich vereinbart worden sein, so verpflichtet sich der Kunde im Falle des Kaufes bzw. des Verkaufes einer Immobilie eine Provision in H\u00f6he von 3,57 % des Kaufpreises inkl. MwSt. zu zahlen. Eine entsprechende Provision wird sowohl vom K\u00e4ufer als auch vom Verk\u00e4ufer erhoben, soweit nicht ausdr\u00fccklich etwas anderes vereinbart ist. Das gilt dann nicht im Verh\u00e4ltnis zum K\u00e4ufer, wenn die Firma Andreas Blex Immobilien als einseitiger Interessenvertreter des Verk\u00e4ufers t\u00e4tig ist und keinen Maklervertrag mit dem Kaufinteressenten abschlie\u00dft.<\/p><p>Im Falle des Nachweises der M\u00f6glichkeit zum Abschluss eines Mietvertrages verpflichtet sich der Auftraggeber\/Besteller, \u2013 sofern nichts anderen vereinbart ist \u2013 eine Provision in H\u00f6he von 2,38 Monatsmieten zu zahlen. Durch die Neufassung des Gesetzes zur Regelung der Wohnungsvermittlung WoVermG wird \u00fcblicherweise der Vermieter der Auftraggeber der Firma Andreas Blex Immobilien sein.<\/p><p>Sollte es in Ausnahmef\u00e4llen zum Abschluss eines Suchauftrages in Textform mit dem Mieter als Auftraggeber der Firma Andreas Blex Immobilien kommen und der Auftrag des Vermieters zur Vermietung einer Wohnung danach von Andreas Blex Immobilien eingeholt werden, betr\u00e4gt die Provision des Mieters 2,38 Monatsmieten inkl. MwSt.<br \/>Sollte eine solche Provision nicht ausdr\u00fccklich vereinbart worden sein, so verpflichtet sich der Kunde im Falle des Kaufes bzw. des Verkaufes einer Immobilie eine Provision in H\u00f6he von 3,57 % des Kaufpreises inkl. MwSt. zu zahlen. Eine entsprechende Provision wird sowohl vom K\u00e4ufer als auch vom Verk\u00e4ufer erhoben, soweit nicht ausdr\u00fccklich etwas anderes vereinbart ist. Das gilt dann nicht im Verh\u00e4ltnis zum K\u00e4ufer, wenn die Firma Andreas Blex Immobilien als einseitiger Interessenvertreter des Verk\u00e4ufers t\u00e4tig ist und keinen Maklervertrag mit dem Kaufinteressenten abschlie\u00dft.<\/p><div class=\"col-md-2\"><div class=\"circle\">Die Provision wird mit Abschluss des vermittelten Vertrages f\u00e4llig und zahlbar. Der Kunde kommt mit der Zahlung in Verzug, wenn er nicht innerhalb von 30 Tagen nach F\u00e4lligkeit und Zugang einer Rechnung oder einer gleichwertigen Zahlungsaufstellung den Honoraranspruch ausgleicht.<\/div><\/div>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-95db78e elementor-widget elementor-widget-text-editor\" data-id=\"95db78e\" data-element_type=\"widget\" id=\"terms3\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<h4>3. Angebote &amp; Daten<\/h4><p>Alle unterbreiteten Angebote der Firma Andreas Blex Immobilien sind unverbindlich und freibleibend. Irrtum und Zwischenverkauf\/Zwischenvermietung bleiben vorbehalten. S\u00e4mtliche Angaben zu den zu vermittelnden Objekten basieren auf Angaben von Dritten. F\u00fcr die Richtigkeit und Vollst\u00e4ndigkeit dieser Angaben \u00fcbernimmt die Firma Andreas Blex Immobilien keine Gew\u00e4hr oder Haftung. Die Firma Andreas Blex Immobilien ist nicht verpflichtet, die Angaben, die sie von Dritten erh\u00e4lt, zu \u00fcberpr\u00fcfen. Eine Haftung f\u00fcr die inhaltliche Richtigkeit und\/oder Vollst\u00e4ndigkeit dieser Angaben wird nur f\u00fcr den Fall eines vors\u00e4tzlichen oder grob fahrl\u00e4ssigen Verhaltens \u00fcbernommen.<\/p><p>Die durch die Firma Andreas Blex Immobilien \u00fcbermittelten Daten und Angebote sind ausschlie\u00dflich f\u00fcr den Empf\u00e4nger bestimmt, diese sind von ihm vertraulich zu behandeln. Eine Weitergabe an Dritte ist nur nach vorheriger Genehmigung durch die Firma Andreas Blex Immobilien \u00a0gestattet. Die Firma Andreas Blex Immobilien verpflichtet sich, s\u00e4mtliche Daten, die sie im Zusammenhang mit ihrer T\u00e4tigkeit erh\u00e4lt, insbesondere die pers\u00f6nlichen Daten der Kunden, vertraulich zu behandeln. Die Firma Andreas Blex Immobilien weist darauf hin, dass s\u00e4mtliche Daten in der Datenverarbeitung gespeichert und aufbewahrt bleiben.<\/p><p>Kommt es infolge der Weitergabe der Daten und Information zu einem Vertragsabschluss eines Dritten mit dem K\u00e4ufer\/Verk\u00e4ufer bzw. Mieter\/Vermieter, so haftet der Kunde der Firma Andreas Blex Immobilien \u00a0auf Schadenersatz in H\u00f6he der Provision.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-673ad03 elementor-widget elementor-widget-text-editor\" data-id=\"673ad03\" data-element_type=\"widget\" id=\"terms4\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<h4>4. Haftung<\/h4><p>Die Firma Andreas Blex Immobilien schr\u00e4nkt ihre Haftung nach den folgenden Regelungen ein: Die gesetzlichen Bestimmungen f\u00fcr Sch\u00e4den an Leben, K\u00f6rper und Gesundheit, die auf einer fahrl\u00e4ssigen oder vors\u00e4tzlichen Pflichtverletzung der Firma Andreas Blex Immobilien, einem gesetzlichen Vertretern oder einem Erf\u00fcllungsgehilfen beruhen, sowie f\u00fcr Sch\u00e4den, die von der Haftung nach dem Produkthaftungsgesetz umfasst werden, sowie f\u00fcr Sch\u00e4den, die auf vors\u00e4tzlichen oder grob fahrl\u00e4ssigen Vertragsverletzungen sowie Arglist der Firma Andreas Blex Immobilien, einem gesetzlichen Vertreter oder Erf\u00fcllungsgehilfen beruhen, gelten uneingeschr\u00e4nkt.<\/p><p>Die Firma Andreas Blex Immobilien haftet auch f\u00fcr Sch\u00e4den, die durch einfache Fahrl\u00e4ssigkeit verursacht werden, soweit diese Fahrl\u00e4ssigkeit die Verletzung solcher Vertragspflichten betrifft, deren Einhaltung f\u00fcr die Erreichung des Vertragszweckes von besonderer Bedeutung ist. Das Gleiche gilt, wenn dem Auftraggeber Anspr\u00fcche auf Schadensersatz statt der Leistung zustehen. Die Firma Andreas Blex Immobilien haftet jedoch nur, soweit die Sch\u00e4den typischerweise mit dem Vertrag verbunden und vorhersehbar sind.<\/p><p>Eine weitergehende Haftung ist ohne R\u00fccksicht auf die Rechtsnatur des geltend gemachten Anspruchs ausgeschlossen; dies gilt insbesondere auch f\u00fcr deliktische Anspr\u00fcche oder Anspr\u00fcche auf Ersatz vergeblicher Aufwendungen statt der Leistung. Soweit die Haftung der Firma Andreas Blex Immobilien ausgeschlossen oder beschr\u00e4nkt ist, gilt dies auch f\u00fcr die pers\u00f6nliche Haftung ihrer Angestellten, Arbeitnehmer, Mitarbeiter, Vertreter oder Erf\u00fcllungsgehilfen.<\/p><p>Die Firma Andreas Blex Immobilien \u00fcberpr\u00fcft die Bonit\u00e4t der nachgewiesenen\/vermittelten Partei nicht und \u00fcbernehmen deshalb auch keine Haftung daf\u00fcr.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-ad3d099 elementor-widget elementor-widget-text-editor\" data-id=\"ad3d099\" data-element_type=\"widget\" id=\"terms5\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<h4>5. Doppelt\u00e4tigkeit<\/h4><p>Andreas Blex ist berechtigt, auch f\u00fcr den anderen Vertragsteil (Verk\u00e4ufer\/Vermieter\/Tauschpartner) entgeltlich oder unentgeltlich t\u00e4tig zu werden. Bei Doppelt\u00e4tigkeit sind wir zur Unparteilichkeit verpflichtet.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-bd2b8ad elementor-widget elementor-widget-text-editor\" data-id=\"bd2b8ad\" data-element_type=\"widget\" id=\"terms6\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<h4>6. Informationspflichten des Auftragsgebers<\/h4><p>Der Kunde verpflichtet sich, Andreas Blex Immobilien umgehend zu informieren, wenn er seine Kauf- bzw. Verkaufs- und\/oder Vermietungsabsicht aufgibt. F\u00fcr den Fall, dass der Verk\u00e4ufer einer Immobilie unter Umgehung der Firma Andreas Blex das Objekt an einen Dritten ver\u00e4u\u00dfert und er zuvor an die Firma Andreas Blex Immobilien einen Makleralleinauftrag erteilt hat, so verpflichtet sich der Verk\u00e4ufer einen pauschalierten Aufwendungs- und Schadenersatz in H\u00f6he von 10 % der vereinbarten Provision zu zahlen. Dem Kunden bleibt es hierbei unbenommen, einen geringeren Schaden nachzuweisen, wie es auch der Firma Andreas Blex Immobilien unbenommen ist, einen h\u00f6heren Schaden nachzuweisen<\/p><p>Wir haben Anspruch auf Anwesenheit bei Vertragsabschluss; der Auftraggeber ist verpflichtet, uns rechtzeitig \u00fcber Ort und Zeit in Kenntnis zu setzen. Sofern aufgrund unserer Nachweis- und\/oder Vermittlungst\u00e4tigkeit direkte Verhandlungen aufgenommen werden, ist auf unsere T\u00e4tigkeit Bezug zu nehmen. Der Inhalt der Verhandlungen ist uns unaufgefordert und unverz\u00fcglich schriftlich mitzuteilen.<\/p><p>Die Verj\u00e4hrungsfrist f\u00fcr die Geltendmachung von Schadens- und Aufwendungsersatz betr\u00e4gt drei\u00a0Jahre.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-82bb338 elementor-widget elementor-widget-text-editor\" data-id=\"82bb338\" data-element_type=\"widget\" id=\"terms7\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<h4>7. Gerichtsstand\u00a0<\/h4><div>Die Firma Andreas Blex Immobilien und ihr Kunde sind sich dar\u00fcber einig, dass Erf\u00fcllungsort und Gerichtstand, soweit gesetzlich zul\u00e4ssig, der Gesch\u00e4ftssitz der Firma Andreas Blex Immobilien in D\u00fcsseldorf ist<\/div>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-460197e elementor-widget elementor-widget-text-editor\" data-id=\"460197e\" data-element_type=\"widget\" id=\"terms8\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<h4>8. Salvatorische Klausel<\/h4><p><span style=\"color: #333333; font-family: Lato, serif; font-size: 13.5pt; letter-spacing: 0px;\">Sollten eine oder mehrere der vorstehenden Bestimmungen ung\u00fcltig sein, so soll die Wirksamkeit der \u00fcbrigen Bestimmungen hiervon nicht ber\u00fchrt werden. Dieses gilt auch, wenn innerhalb einer Regelung ein Teil unwirksam ist, ein anderer Teil aber wirksam. Die jeweils unwirksame Bestimmung soll zwischen den Parteien durch eine Regelung ersetzt werden, die den wirtschaftlichen Interessen der Vertragsparteien am n\u00e4chsten kommt und im \u00dcbrigen den vertraglichen Vereinbarungen nicht zuwider l\u00e4uft.<\/span><\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-bda9337 elementor-widget elementor-widget-text-editor\" data-id=\"bda9337\" data-element_type=\"widget\" id=\"terms9\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<h4>Impressum<\/h4>\n<p style=\"--brlbs-tw-border-spacing-x: 0;
